Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Tradeart web application and related services (the “Service”), operated by Andrii Levchenko, a sole proprietor (Einzelunternehmer) registered in Austria. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Tradeart is a trade journaling and analytics tool. It helps traders log trades manually, optionally synchronise trade history from MetaTrader 5 accounts, organise notes and strategies, and review their own performance through dashboards and analytics.
Tradeart is not a broker, financial advisor, or investment service. The Service does not execute trades, does not provide personalised investment advice, and does not handle client funds. Any information, metric, simulation, or AI-generated text produced by the Service is informational and educational only and must not be interpreted as a recommendation to buy, sell, or hold any financial instrument.
2. Eligibility and account
You must be at least 18 years old and legally able to enter into a binding contract in your country of residence. You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential. You are responsible for all activity that occurs under your account.
We may suspend or terminate accounts that violate these Terms, abuse the Service, or attempt to compromise its security or integrity.
3. Subscription, pricing and trial
Tradeart offers a free tier with limited functionality and a paid Premium subscription. Current pricing for Premium:
- Monthly plan: USD 12 per month, billed monthly.
- Annual plan: USD 96 per year, billed once per year (equivalent to USD 8 per month).
New users may start a 14-day free trial of Premium. No payment is taken during the trial. If you do not cancel before the trial ends, your subscription automatically converts to a paid plan and the first payment is charged to your payment method.
Subscriptions renew automatically at the end of each billing period at the then-current price for the same plan, unless you cancel before the renewal date. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you keep Premium access until then.
All prices are in US dollars and are shown net of any applicable taxes. As the operator is currently registered as a small business (Kleinunternehmer under § 6 Abs. 1 Z 27 UStG, Austria), no VAT is charged. If this status changes, prices may be updated accordingly with prior notice.
Payments are processed by Stripe Payments Europe, Ltd. Tradeart does not store full payment card details on its own servers. Your use of the payment service is also subject to Stripe’s terms and privacy policy.
4. Right of withdrawal and refunds (EU consumers)
If you are a consumer resident in the European Union, you generally have the right to withdraw from a distance contract within 14 days under the Austrian Fern- und Auswärtsgeschäfte-Gesetz (FAGG), without giving any reason.
However, the Service is a digital service that is supplied immediately upon activation of your subscription. By starting your paid subscription, you expressly request immediate performance of the Service and acknowledge that you lose your right of withdrawal as soon as performance has begun, in accordance with § 18 Abs. 1 Z 11 FAGG.
The 14-day free trial is not a paid contract. You can cancel during the trial at any time without any charge. Once a billing period has started, fees already paid are non-refundable, except where mandatory consumer law in your country of residence requires otherwise.
5. MetaTrader connections and third-party data
You may optionally connect MetaTrader 5 (MT5) trading accounts to the Service in order to import historical trades. To do so, you provide credentials for a read-only investor or trading login of your account; these credentials are encrypted at rest. You are responsible for ensuring that connecting your account complies with the terms of your broker.
The Service uses third-party providers (such as market data vendors and an economic calendar feed) to display reference data such as prices and news events. We do our best to keep this data accurate but it is provided “as is” and may contain errors, delays, or gaps. You must not rely on it for trading decisions.
6. AI features
Some features of the Service generate written explanations or suggestions using artificial intelligence. When you explicitly trigger an AI feature, the relevant subset of your trading data (such as filter rules, baseline and scenario statistics, language preference) is sent to third-party AI providers for processing — currently including Google Gemini via a secure API gateway.
AI output is generated automatically, may be inaccurate or incomplete, and must be treated as informational only. It is not financial advice and you remain fully responsible for any decision you take.
7. Acceptable use
You agree not to:
- use the Service in violation of applicable law or third-party rights;
- reverse-engineer, scrape, or attempt to gain unauthorised access to the Service or its underlying systems;
- use the Service to send spam, malware, or content that is illegal, harmful, or infringing;
- resell, sublicense, or commercially redistribute the Service or AI-generated outputs without prior written consent;
- impersonate another person or misrepresent your affiliation.
8. Your content
You retain all rights to the data you submit to the Service (trades, notes, screenshots, strategies, etc.). You grant us a limited, non-exclusive licence to host, process, back up, and display your content solely as needed to provide the Service to you. We do not sell your content and do not use it to train AI models.
9. Intellectual property
The Service, including its source code, design, brand, name “Tradeart”, logo, analytics methodology, and documentation, is the intellectual property of Andrii Levchenko and is protected by Austrian and EU law. You receive a personal, non-exclusive, non-transferable right to use the Service in accordance with these Terms; no other rights are granted.
10. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, fully accurate, or that analytics, simulations, or AI outputs will be reliable for any particular purpose. Statutory consumer warranty rights remain unaffected.
11. Limitation of liability
To the extent permitted by applicable law, Andrii Levchenko shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to trading losses, lost profits, lost data, or lost opportunity, arising out of or in connection with your use of the Service.
For damages caused by slight negligence (leichte Fahrlässigkeit), our total aggregate liability is limited to the fees you have paid for the Service in the twelve (12) months preceding the event giving rise to the claim. This limitation does not apply to liability for personal injury, for damages caused by gross negligence or intent, nor to any other liability that cannot be excluded or limited under mandatory Austrian law.
12. Suspension and termination
You may delete your account at any time from your account settings. Deletion removes your personal data and trading data from the Service in line with our Privacy Policy. We may suspend or terminate your access if you breach these Terms, if required by law, or if continued provision of the Service is no longer reasonably possible.
13. Changes to the Service and to these Terms
We may modify the Service or these Terms from time to time, for example to reflect changes to features, pricing, or legal requirements. We will notify you of material changes by email or through the Service at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may cancel your subscription and delete your account.
14. Governing law and jurisdiction
These Terms are governed by the laws of Austria, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection rules of your country of residence within the EU remain unaffected.
The competent courts of Vienna, Austria shall have jurisdiction for any disputes arising out of or in connection with these Terms, subject to mandatory rules of jurisdiction in favour of consumers. EU consumers may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
